These Terms of Use (the "Terms") govern your access to and use of the TubeFetcher website and software (collectively, the "Service"). By downloading, installing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1) Who may use the Service

You must be at least the age of majority in your jurisdiction to use the Service. You may use the Service only for lawful, personal, and non-commercial purposes and only in accordance with these Terms and all applicable laws.

2) Third-party platforms & content

TubeFetcher interacts with third-party services (for example, video platforms such as YouTube). Your use of those services is governed by their own terms and policies. You are solely responsible for ensuring that your use of the Service complies with any third-party terms, including prohibitions on downloading or copying content. Do not use TubeFetcher to access, download, or distribute content when you lack permission or when doing so would violate another party's rights or a platform's terms.

3) License and restrictions

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the TubeFetcher app on devices you own or control. You may not: (a) reverse engineer, decompile, or attempt to derive the source code except to the extent permitted by applicable law; (b) circumvent technical measures, DRM, encryption, or access controls; (c) use the Service to infringe, misappropriate, or violate intellectual-property or privacy rights; (d) use the Service to provide a competing or commercial service; (e) interfere with or disrupt the operation of the Service.

4) Your responsibilities

You are responsible for any content you obtain with the Service and for how you use it. We do not host or store copies of third-party videos for you. You must obtain all necessary permissions, and you are solely responsible for compliance with copyright and other laws. If you share or publish content obtained via TubeFetcher, you must ensure you have the right to do so.

5) Updates; changes to the Service

We may release updates or changes to the Service at any time. Updates may be installed automatically. We may suspend, discontinue, or modify any part of the Service without liability.

6) Privacy

Your use of the Service is also subject to our privacy policy. We avoid tracking by default; any optional diagnostics you enable are processed as described there.

7) Intellectual property

We and our licensors own all rights in the Service, including software, branding, and design. These Terms do not transfer any ownership rights to you.

8) Open-source components

The Service may include open-source components licensed under their own terms. Those licenses govern the respective components.

9) Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT IT WILL WORK WITH EVERY THIRD-PARTY SITE OR CONTENT.

10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED (100) EUR OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

11) Indemnification

You agree to indemnify and hold TubeFetcher and our affiliates, officers, employees, and agents harmless from any claim, liability, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service or violation of these Terms.

12) Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or used the Service unlawfully. You may stop using the Service at any time. Upon termination, your license ends and you must cease all use.

13) Governing law; venue

These Terms are governed by the laws of Israel, without regard to conflict-of-law rules. The courts of Tel Aviv, Israel will have exclusive jurisdiction for any disputes arising from these Terms or your use of the Service.

14) Export & sanctions compliance

You represent that you are not located in a country subject to comprehensive sanctions and are not a denied or restricted party under applicable export laws. You will not export or re-export the Service in violation of such laws.

15) Changes to these Terms

We may revise these Terms from time to time. The date at the top shows when they were last updated. Material changes will apply prospectively. Your continued use of the Service after changes become effective constitutes acceptance.
